Terms of Sale

1. Scope
These Terms of Sale govern all purchases made on lochfit.com, operated by LochFit, a business registered in France under SIREN/SIRET [NUMBER], with its registered office in Paris - France. These Terms apply to all customers, including those located in the United States, and take precedence over any other document unless otherwise agreed in writing.
2. Products
Products offered for sale are described and presented as accurately as possible. Photos and descriptions are provided by our fulfillment partners and, despite our best efforts, minor variations in color, packaging, or appearance may occur and do not constitute a defect.
3. Prices
Prices are displayed in USD and include all applicable taxes unless stated otherwise. As sales are made to customers outside the European Union, French VAT does not apply to these transactions. Prices do not include any customs duties or import taxes that may be charged by US customs authorities, which remain the customer's responsibility (see our Shipping Policy).
We reserve the right to modify prices at any time; the price applicable is the one displayed at the time of order confirmation.
4. Order Process
An order is considered final once payment has been confirmed and you receive an order confirmation email. We reserve the right to cancel or refuse any order in cases of pricing errors, suspected fraud, or unavailability of the product, in which case you will be fully refunded.
5. Payment
Payment is due in full at the time of order. We accept the payment methods listed at checkout ([e.g., credit/debit card, PayPal, Shop Pay]). Payment is processed securely through third-party payment providers; we do not store your full payment card details.
6. Delivery
Delivery terms, estimated timeframes, and shipping costs are set out in our Shipping Policy, incorporated into these Terms by reference. As products are shipped from international fulfillment partners, delivery times of 7–20 business days should be expected.
7. Right of Withdrawal / Cancellation
Because our products are sold exclusively to customers located outside the European Union, the EU's mandatory 14-day right of withdrawal does not apply to these sales. Instead, order cancellations and returns are governed by our Return & Refund Policy, incorporated into these Terms by reference, which sets out your rights to cancel, return, or request a refund.
8. Warranty
Products are covered by the warranty terms described in our Return & Refund Policy for items that arrive damaged, defective, or non-conforming to their description. Nothing in these Terms excludes any warranty or consumer protection right you are entitled to under mandatory law in your place of residence.
9. Liability
LochFit cannot be held liable for delays or non-performance of the contract resulting from events outside its control (force majeure), including but not limited to customs delays, carrier disruptions, or fulfillment partner issues. Our liability for any claim is limited to the amount paid for the product concerned, except where such limitation is not permitted under applicable mandatory law.
10. Personal Data
Personal data collected during the order process is processed in accordance with our Privacy Policy, in compliance with the EU General Data Protection Regulation (GDPR), as LochFit is established in France.
11. Dispute Resolution
In the event of a dispute, customers are encouraged to first contact us at contact@lohfit.com to seek an amicable resolution. These Terms of Sale are governed by French law, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
